    Thank you for visiting our website at www.pvcycle.org, hereinafter referred to as the "Website", operated by PV CYCLE AISBL, having its registered office in Belgium, 1200 Brussels, Boulevard Brand Whitlock 114, registered with the KBO/BCE under number 0893.027.827, hereinafter referred to as "PV CYCLE".

    Please read these Terms of Use carefully. They set out the conditions for accessing and using the Website.

    Upon any registration (hereinafter referred to as "Registration"), you will be asked to confirm that you have read these Terms of Use and accept their content as binding. Your visit to the Website as well as your Registration automatically imply that you know and accept these Terms of Use.

    1. Definitions

    For the purposes of these Terms of Use, the following terms always have the same meaning:

    "Account": A personal user account created by the Website once the user has registered and completed the registration form available on the Website:

    • on the pvcycle.org subdomain, where Italian users can register as members and obtain a personal user account;
    • on the printservice.pvcycle.org subdomain, where PV CYCLE members and collection points can create a personal user account to request quotes and have PV CYCLE documents printed directly through PV CYCLE's preferred printing partner.

    "Content": The information freely available on the Website, including articles, editorial content and other information about PV CYCLE and its services.

    "PV CYCLE": PV CYCLE AISBL, having its registered office in Belgium, 1200 Brussels, Boulevard Brand Whitlock 114, registered with the KBO/BCE under number 0893.027.827.

    "Private Area": A shared download center for members and collection points, accessible after registering as a PV CYCLE member or partner. Usernames and passwords are created and provided by PV CYCLE and updated periodically. The Private Area contains additional information reserved exclusively for PV CYCLE partners and members.

    "Registration Form": The (electronic) form used by a person or company to apply for membership or partnership with PV CYCLE and to register as a user of the Website.

    "Terms of Use": These terms governing access to and use of the Website.

    "User": The company or person using the Website.

    "Website": PV CYCLE's website at the following URL: www.pvcycle.org.

    2. Purpose of the Website

    The Website serves as a communication tool with the following objectives:

    • Promoting PV CYCLE's services, in particular the take-back and recycling of used photovoltaic modules in EU and EFTA countries;
    • Providing information about PV CYCLE and its services to members, recycling partners, manufacturers and end customers;
    • Allowing sign-up for the PV CYCLE newsletter;
    • Enabling users to apply for membership or partnership with PV CYCLE and to manage their WEEE compliance.

    3. Scope and Binding Effect

    These Terms of Use apply to any use of the Website, whether viewing content, registering, or subscribing to newsletters.

    The User confirms having read these Terms of Use and acknowledges their binding effect.

    4. Registration on the Website

    If the User wishes to become a PV CYCLE member or partner, they must complete the registration form available on the Website with their personal details. The form must be completed fully and accurately.

    Users are not permitted to use the identity of another person, proxies, or temporary email addresses.

    During registration, the User must accept these Terms of Use as well as the Privacy and Cookie Policy by ticking the relevant checkbox.

    After completing the registration form, users receive a service agreement (by email), which must be signed and returned to PV CYCLE.

    Upon receipt of payment of the administrative fees, membership contributions and other legally required WEEE contributions, users receive the PV CYCLE certificate, valid for a full year of membership, as well as access to the private area for members and partners and, where applicable, to user accounts.

    Members and collection points who have registered an account on pvcycle.org receive a confirmation email after completing the registration form.

    PV CYCLE reserves the right to accept or reject registrations. A registration may be rejected in particular for the following reasons:

    • The User does not provide the requested identification data or submits incomplete or incorrect information;
    • The User attempts to register multiple times under different aliases;
    • The User uses the identity of another person;
    • The User does not comply with these Terms of Use, has failed to comply with them in the past, or PV CYCLE has legitimate reason to believe this will also be the case in the future;
    • Any other reason PV CYCLE reasonably considers sufficient to reject the registration.

    5. Access to the Website and to an Account

    Membership with PV CYCLE is not free of charge. Membership fees, contributions and other legally required WEEE charges must be paid as indicated in the registration form. Registration as a partner is free of charge.

    The information available on the Website is freely accessible to users.

    PV CYCLE reserves the right to warn users, temporarily or permanently deny them access to their account, or temporarily or permanently block access to the Website by blocking the IP address.

    Access may be denied, among other reasons, for the following:

    • The User has registered incompletely or incorrectly, or has completed the registration form incompletely or incorrectly;
    • The User has shared their access credentials with third parties;
    • The User uses a third party's access credentials;
    • The User attempts to use their account to cause harm or misuses it;
    • The User does not comply with these Terms of Use, has failed to comply with them in the past, or PV CYCLE has legitimate reason to believe this will also be the case in the future;
    • Any other reason PV CYCLE reasonably considers sufficient to deny access.

    PV CYCLE reserves the right to unilaterally, immediately, permanently and without prior notice close an account or deny a user access to the Website if the user breaches these Terms of Use.

    6. Limitation of Liability

    PV CYCLE devotes great care and attention to the content of the Website. However, this content may be changed or removed at any time and is provided to the User without any express or implied warranty as to its accuracy. PV CYCLE is not liable for damages arising from the use of the Website's content, whether or not it appears correct, nor for damages caused by the use or distribution of such content.

    PV CYCLE strives to provide 24/7 access to the Website. However, due to the technical characteristics of smartphones, computers and the internet, as well as the need for regular maintenance, updates and improvements, PV CYCLE cannot guarantee uninterrupted access. PV CYCLE will make every effort to resolve reasonable interruptions or access restrictions such as server outages, errors, bugs or viruses affecting the Website as quickly as possible. Such interruptions or restrictions shall not be considered a failure on the part of PV CYCLE and shall not give rise to any right to compensation.

    Third-party websites occasionally referenced by the Website are neither managed, hosted nor maintained by PV CYCLE. PV CYCLE is not responsible for the content of these websites, nor for the links they contain or their modifications and updates. PV CYCLE pays particular attention to the inclusion of links to third-party websites as well as to the publication of newsletters and the occasional sending of emails. Nevertheless, PV CYCLE cannot guarantee that these links will always work or that emails will reach the User in a timely or legible manner. In the event of normal and reasonable interruptions, PV CYCLE will do everything reasonably possible to resolve them quickly. Under no circumstances can PV CYCLE be held liable for this.

    7. Fair and Secure Use of the Website

    By registering and using the Website, the User undertakes to:

    • use the Website in accordance with these Terms of Use and the Privacy and Cookie Policy;
    • act as a responsible and prudent user;
    • not harm PV CYCLE in any way;
    • not register on the Website under different usernames;
    • provide accurate, current and complete information when registering;
    • not use the identity or name of another person or organization;
    • not use the usernames or passwords of others;
    • keep their access credentials confidential and ensure they are not used by third parties;
    • inform PV CYCLE immediately of any misuse of access credentials;
    • inform PV CYCLE immediately of any misuse or security breach relating to their account;
    • not violate, copy, distribute, sell or circumvent the Website's security measures;
    • never disrupt access to or operation of the Website's IT infrastructure;
    • adequately protect their data, software and computer or telecommunications systems against viruses and similar risks, including cyberattacks.

    The User releases PV CYCLE from any liability and holds PV CYCLE harmless against claims by authorities or third parties in connection with a breach by the User of these Terms of Use, and shall compensate PV CYCLE for any resulting damages.

    8. Intellectual Property

    PV CYCLE is and remains the sole owner or licensee of all intellectual property rights relating to the Website and its services. The User undertakes not to copy, sell or otherwise use any part of the Website or its services without prior authorization.

    The use of links to the homepage or to specific pages of the Website requires PV CYCLE's authorization. Please send requests to media@pvcycle.org.

    PV CYCLE authorizes certain media files (see Media/Downloads) for public use. As long as their integrity is preserved and PV CYCLE's copyright is properly credited, no further authorization is required. For further information on using PV CYCLE's media files, please contact media@pvcycle.org.

    9. General Provisions

    Amendments

    If these Terms of Use are amended, the amended version will be published on the Website and will apply from the User's first visit after the amendment. From that point on, the User will be deemed to have read and accepted the changes. It is therefore important to check the date of the last update on each visit.

    Applicable Law and Jurisdiction

    These Terms of Use are governed by and construed and performed in accordance with Belgian law. In the event of a dispute, Belgian law shall apply exclusively.

    The courts of Brussels shall have exclusive jurisdiction over any disputes.
