Industrial batteries

The Battery Act Implementation Act (BattDG) is the German law implementing Regulation (EU) 2023/1542 on batteries and waste batteries. It establishes the legal framework for the placing on the market, take-back, and environmentally sound disposal of batteries in Germany.

Industrial batteriesconstitute a specific category of batteries under the law. This group includes batteries designed for industrial purposes, such as stationary energy storage systems in the photovoltaic industry. Commonly used chemical systems in this sector include:

Lithium-ion systems (Li-ion).
Lithium iron phosphate systems (LFP).

Manufacturers (as well as importers and, under certain conditions, retailers) are subject to extended producer responsibility. This means that they are responsible for the entire life cycle of the batteries they place on the market. The most important obligations include:

1. Registration requirement: Manufacturers must register with the competent authority, the ear Foundation, before placing batteries on the market. Without this registration, distribution is prohibited.

2. PRO participation requirement: Regardless of the battery category, you are required to participate in a Producer Responsibility Organisation (PRO).

3.Treatment and Recycling: All collected used batteries must be sent for material recycling at certified facilities using state-of-the-art technology.

4. Financing: Manufacturers are responsible for all costs associated with collection, ADR-compliant transport, logistics, documentation, and proper recycling.

5. Reporting Requirements: There is a requirement to report regularly on the quantities placed on the market, as well as on the used batteries that have been collected and recycled.

Manufacturers are required to join an OfH. Such an organisation handles the operational implementation of manufacturer obligations, provides legally compliant collection containers, and guarantees compliance with all environmental and safety standards.
